Welcome to TripnCity.com

These Terms of Service ("Terms") govern your use of the TripnCity.com website and mobile application (the "Platform") operated by SaasFactory LLC ("SaasFactory," "TripnCity," "we," "us," or "our"). SaasFactory LLC also operates bein.city and travelto.city platforms under the same terms and conditions.

1.1 Acceptance of Terms

By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Platform.

1.2 Description of Service

TripnCity.com is an online marketplace that connects travelers with local tour guides and travel agencies in Portugal, Spain, and Morocco. We facilitate bookings but are not the tour operator or service provider.

1.3 User Accounts

Account Registration:

  • You must provide accurate, complete information
  • You are responsible for maintaining account security
  • One account per person/entity
  • Minimum age requirement: 18 years old

Account Responsibilities:

  • Keep login credentials confidential
  • Notify us immediately of unauthorized access
  • Ensure all information remains current and accurate

1.4 Platform Usage

Permitted Uses:

  • Browse and book tour services
  • Leave honest reviews after completed bookings
  • Communicate with guides through our messaging system
  • Share content in accordance with these Terms

Prohibited Uses:

  • Fraudulent or illegal activities
  • Harassment or abusive behavior toward guides or other users
  • Circumventing our booking system to avoid fees
  • Posting false or misleading information
  • Automated data collection (scraping)

1.5 Booking Process

How Bookings Work:

  • Bookings are contracts between you and the guide/agency
  • TripnCity facilitates the transaction but is not a party to it
  • Payment is processed through our secure payment system
  • Confirmation emails contain booking details and guide contact information

Booking Modifications:

  • Changes subject to guide availability and policies
  • Modification fees may apply
  • Cancellations governed by our Cancellation Policy

1.6 Pricing and Fees

Tour Prices:

  • Set by individual guides and agencies
  • Displayed in local currency and converted for reference
  • Include all specified services as described
  • Exclude personal expenses unless stated otherwise
  • Payment processing fees are charged to the guide/agency partner

Platform Fees:

  • Platform fees range from 10% to 13% of booking value depending on partner's service tier and offering quality
  • Processing fees (credit card, PayPal, Stripe Connect, etc.) are charged separately to partners
  • No additional booking fees charged to travelers
  • Currency conversion fees may apply for international transactions

Processing Fee Structure (Charged to Partners):

  • Domestic Credit/Debit Cards: 2.9% + $0.30 per transaction
  • International Cards: 2.9% + $0.30 + 1.5% additional fee per transaction
  • Digital Wallets (Apple Pay, Google Pay): 2.9% + $0.30 per transaction
  • Currency Conversion: Additional 1% when currency conversion required
  • Chargeback Disputes: $15 per dispute
  • Failed ACH Payments: $4 per failed payment
  • Wire Transfers: $8 per transaction
  • Instant Payouts: 1% of payout amount (optional service)

1.7 Reviews and Content

Review Guidelines:

  • Based on actual experiences only
  • Honest, fair, and relevant to the tour
  • No promotional content or competitor mentions
  • We reserve the right to remove inappropriate reviews

User-Generated Content:

  • You grant us license to use your content for promotional purposes
  • You retain ownership of your content
  • Content must comply with our Community Guidelines

1.8 Limitations of Liability

Service Disclaimer:

  • TripnCity is a marketplace platform only
  • We do not provide tour services directly
  • Guides and agencies are independent contractors
  • We do not guarantee tour quality or outcomes

Liability Limitations:

  • Our liability is limited to the booking value
  • We are not responsible for guide actions or tour quality
  • Force majeure events exclude liability
  • Users participate in tours at their own risk

1.9 Dispute Resolution

Resolution Process:

  1. Contact our customer support within 24 hours of the issue
  2. We will facilitate communication with the guide/agency
  3. If unresolved, binding arbitration in accordance with local laws
  4. Arbitration location: User's country of residence

1.10 Termination

We may terminate accounts for:

  • Violation of these Terms
  • Fraudulent activity
  • Abusive behavior
  • Non-payment of fees

1.11 Governing Law

These Terms are governed by:

  • US Users: Laws of California, United States
  • EU Users: Laws of Spain and EU regulations
  • Other Users: Laws of California, United States
  • Disputes subject to jurisdiction of California courts or user's local jurisdiction

1.12 Changes to Terms

We reserve the right to modify these Terms at any time. Users will be notified of material changes via email or platform notification.
